The Ruling 

On December 13, the FCC issued a definitive ruling to address what is commonly referred to as the “Lead Generator Loophole.” This ruling introduces a few new requirements in communication and consent including a new requirement termed “one-to-one” (OTO), mandating that lead generation websites prominently display this feature. Under this regulation, consumers must actively select the specific entities —whether one or more— they grant consent to contact them. The FCC explicitly stated that marketing partner lists, which currently feature multiple entities, do not meet the consent standards outlined in the Telephone Consumer Protection Act, or TCPA, regulations.
